Section 16 contains a binding arbitration clause and a CLASS ACTION WAIVER. By agreeing to these Terms you agree that:
You may opt out of arbitration within 30 days by emailing [email protected]. Opting out costs you nothing and does not affect your account. You may also bring an individual claim in small claims court at any time.
Ante is a fitness accountability service. You set a fitness goal, stake your own money on it, and — if you choose — nominate an accountability partner. Your workouts are verified automatically through Apple Health or a connected fitness service.
Ante is not gambling. There is no chance, no house, no odds, and no random element. The outcome of every challenge is determined solely by your own physical activity. You cannot lose because of anything outside your control, and no user ever wins money staked by another user.
Ante is not a bank, money transmitter, escrow agent, or payment service. We do not hold funds on your behalf — see section 4.
These Terms form a binding agreement between you and Ante LLC ("Ante", "we", "us"). By creating an account you accept them. If you do not accept them, do not use Ante.
When you start a challenge you are charged two separate amounts:

The service fee pays for running your challenge: verification, tracking, reminders, and support. It is charged whether you succeed or fail and is earned when your challenge starts. It is not returned if you complete your goal, and it is not returned if you cancel.
Stakes are limited to $5–$200 per challenge.
Payments are processed by Stripe. Ante never receives or stores your card number. Your card details are governed by Stripe's own terms and privacy policy.
Please read this section. The service fee is Ante's revenue from the moment it is paid.
Your stake is held as a general obligation of Ante. It is not placed in a segregated account, a trust, or an escrow arrangement, and it is not insured. It is not protected from Ante's creditors. If Ante ceases operating, you would be an unsecured creditor and your stake may not be returned.
Your right to a refund on completion is a contractual right against Ante. It is not a property interest in any specific funds. We say this plainly because it is true and you are entitled to know it before you commit money.
It is your responsibility to sync before your deadline. Ante allows a 24-hour grace period after the end date for late syncs, but is not liable if a workout fails to sync or verify for any reason, including a dead battery, lost connection, a device fault, or an outage at Apple, Strava, Garmin, or Ante itself. If that happens, dispute the result under section 7 — we would rather fix it than keep money we shouldn't have.
How close you got matters. If you fall short but made real progress, part of your stake is returned to you:

This is decided once, at your deadline, purely by the activity we verified. It is not a second chance, a rematch, or a way to win anything back — there is nothing to play for after the deadline, and no way to change the outcome once it is set.
The rest of your stake is forfeited and becomes Ante's revenue. The service fee is not refunded in any case, including when part of your stake is returned.
If you nominated an accountability partner, Ante will offer that person a reward, paid from Ante's own funds. The reward is based on the size band your stake falls into, scaled by how far short you fell — the closer you got, the smaller their reward. It is not your stake passed along, and it is always less than what you staked.

If you committed without a partner, there is no recipient. Whatever is not returned to you under the table above is forfeited to Ante, and no reward is paid to anyone.
An accountability partner must be someone you are already connected to on Ante, who has accepted your friend request. You cannot direct a reward to an arbitrary email address or phone number. This is deliberate — see section 8.
The reward must be claimed within 30 days. An unclaimed reward expires and is not paid — Ante is not holding that money for anyone. Rewards totalling $600 or more to one person in a calendar year require a Form 1099-NEC, and we will ask for the information needed to issue it. It is your partner's responsibility to report reward income as their own tax situation requires.
If you miss a goal, nothing happens immediately. Your challenge is marked provisionally missed and you have 72 hours to dispute the result before anything is final. During that window no money moves, no statistics change, and your streak is untouched.
You can dispute because a workout didn't sync, a service was down, we got it wrong, your account was compromised, or because you were injured, unwell, or it wasn't safe to train.
Health comes first. If you were injured, became ill, became pregnant, or conditions made training unsafe, tell us and your commitment is returned. No proof is required. We would rather refund you than have you train hurt.
Ante grants two health-related voids per rolling 12 months as routine. Beyond that a person reviews the dispute before deciding — but you can always report an injury, without limit, and nothing in this section is a reason not to tell us. We respond to disputes within 5 business days. Our decision on a disputed challenge is final, which does not affect your rights under section 16.
Ante is an accountability service. You may not use it to transfer money. Specifically, you may not:
We monitor for these patterns. Accounts found doing this are permanently banned, pending commitments are forfeited, and rewards are not paid.
Ante is not a medical service and provides no medical advice.
You assume all risk of physical injury arising from activity you undertake. You are solely responsible for choosing goals appropriate to your fitness, health, and circumstances.
Ante Premium is an auto-renewing subscription, currently $19.99 per year or $4.99 per month.
You acknowledge that these Terms are between you and Ante only, not with Apple, and that Apple is not responsible for Ante or its content.
You are responsible for keeping your login secure and for all activity under your account. Tell us immediately if you believe it has been compromised. We may suspend or terminate an account that violates these Terms; where we do, we will return any stake not already forfeited unless the violation is fraud.
You may delete your account at any time in Settings. Section 10 explains what happens to an active stake.
To the maximum extent permitted by law:
Some jurisdictions do not allow these limitations, in which case they apply to the fullest extent permitted.
You agree to indemnify Ante against claims arising from your use of the service, your violation of these Terms, or your violation of any law or third-party right.
This affects how disputes are resolved. Please read it.
Any dispute arising out of these Terms or your use of Ante will be resolved by binding individual arbitration, not in court, and not as a class action.
Before starting arbitration, please email [email protected] describing the dispute. Most problems are faster to fix directly, and we will try to resolve it within 30 days.
You may opt out of arbitration by emailing [email protected] within 30 days of first accepting these Terms, with your name and account email. Opting out does not affect any other part of these Terms and will not affect your account.
If the class-action waiver is found unenforceable as to a particular claim, that claim proceeds in court and the rest of this section still applies to all other claims.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
We may update these Terms. Material changes will be notified in the app and take effect 30 days after notice. Changes never apply retroactively to a challenge already underway. Continuing to use Ante after changes take effect means you accept them.
If any provision is found unenforceable, the rest remains in force.
